Terms of Use

1. Eligibility — 21+

The Site promotes an alcohol brand. You must be at least 21 years of age (or the legal drinking age in your jurisdiction, whichever is higher) to use the Site.

By using the Site, you represent that you meet this age requirement. We may restrict access where required by law.

2. What this Site is (and is not)

Pre-launch brand site. Super Cock beer is not yet commercially available through this Site. v1 is for:

• Brand and lifestyle storytelling
• Founders Club email signup
• General information about our direction and merchandise plans

No online sales (v1). The Site does not sell beer, merchandise, or other products. Any future e-commerce will be subject to separate terms shown at checkout.

Informational only. Content on the Site is for general information and brand communication. It is not professional, legal, medical, or financial advice.

3. Founders Club

When you join the Founders Club, you agree to:

• Provide a valid email address you control
• Receive email updates from Super Cock Brewing, LLC about launch, product, and brand news
• Unsubscribe at any time via the link in our emails

Founders Club membership does not guarantee product availability, pricing, or allocation. Benefits described on the Site are subject to change.

4. Intellectual property

The Site and its content — including text, logos, rooster design, photography, graphics, layout, and trade dress — are owned by Super Cock Brewing, LLC or our licensors and are protected by copyright, trademark, and other laws.

SUPER COCK and associated branding are trademarks of Super Cock Brewing, LLC (U.S. application pending).

You may not, without our prior written permission:

• Copy, modify, distribute, or create derivative works from Site content
• Use our trademarks, logos, or photography in a way that suggests endorsement
• Frame, mirror, or scrape the Site for commercial use
• Remove copyright or trademark notices

Limited personal, non-commercial viewing is permitted.

5. Acceptable use

You agree not to:

• Use the Site for any unlawful purpose
• Attempt to gain unauthorized access to our systems or data
• Introduce malware, bots, or harmful code
• Interfere with Site operation or other users' access
• Impersonate Super Cock or any person or entity
• Harvest email addresses or personal data from the Site
• Use the Site in any way that could damage our reputation or violate applicable alcohol advertising rules

We may suspend or block access for conduct we believe violates these Terms or applicable law.

6. User submissions

If you send us email, feedback, ideas, or other submissions:

• You grant us a non-exclusive, royalty-free license to use them for business purposes without obligation to you
• You represent that you have the right to share them and that they do not violate third-party rights
• We are not required to respond, implement, or keep submissions confidential

Do not send unsolicited proprietary brewing recipes or confidential business information unless we have agreed in writing.

7. Third-party links

The Site may link to third-party sites (e.g. Instagram, Kit signup flows). We do not control and are not responsible for those sites or their content. Your use of third-party services is at your own risk and subject to their terms.

8. Disclaimer of warranties

The Site is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses.

9. Limitation of liability

To the maximum extent permitted by law, Super Cock Brewing, LLC and its members, managers, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Site.

Our total liability for any claim arising from these Terms or the Site will not exceed one hundred U.S. dollars (USD $100) or the amount you paid us in the twelve months before the claim, whichever is greater.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless Super Cock Brewing, LLC and its members, managers, officers, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any third-party rights.

11. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Pinellas County, Florida, and you consent to personal jurisdiction there.

12. Changes

We may update these Terms at any time. The "Effective date" above will change when we do. Continued use of the Site after changes constitutes acceptance of the updated Terms.

13. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

14. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Super Cock Brewing, LLC regarding the Site.
